Indore: Department of Higher Education (DHE) has cracked the whip on aided colleges not complying with its and court’s orders of granting salary of teachers who were reappointed after being retired at the age of 62. The DHE has directed all universities in the state not to grant affiliation to the aided colleges for session 2019-20 until its order.  It also stated that the recognition to the deviant colleges would be withdrawn and they would not be allowed take admission for next session. Unfolding the past, the government had fixed retirement age of a teacher of aided college at 62 and his counterpart from government run college at 65. Challenging this dual policy, some teachers had moved court who observed that the government can’t discriminate among teachers from aided and government colleges.

Madhya Pradesh High Court, however, had ruled the petitioner should be allowed to work till he attains the age of 65 years and the salary to the petitioner shall be paid by the management of the institution and the government shall not be burdened with payment of salary. The HC court order was challenged in Supreme Court that also made identical observation. The SC also directed to ensure that all those teachers who were retired after the age of 62 years should be re-appointed till age to 65 years. The SC had fixed the deadline for compliance of its order till December 30-11-2018.  Citing the directives of SC, the DHE had directed the colleges to reappoint those retired at the age of 62 years and allow them to work till age of 65 years. It also directed the college management to pay salary of such teachers who cross the age of 65 years, from its own resources. The colleges have not been complying with the orders so now the DHE has tightened the noose directing the universities not to grant affiliation till next order. Earlier, the DHE had threatened to auction immovable assets of colleges to pay salary of teachers.
