A special bench of Justice SC Sharma and Justice Virendra Singh held hearing at 9 pm following a writ filed by Sethi’s wife Prerna fearing demolition by Indore Municipal Corporation (IMC).
The stay was granted when petitioner’s counsel stated that the petitioner would get illegally built portion of her house at Bima Nagar demolished. The IMC claimed that Sethis had even used minimum open space (MOS) from all four sides and the house. Prerna had filed a petition in the High Court challenging the notice.
Single bench of High Court two days ago had disposed of the petition directing the IMC to act as per norms. On Tuesday, Prerna filed a writ appeal in the court stating that IMC told her that they would be demolishing her house any time. Fearing demolition in the night or Wednesday morning, she filed writ with request for hearing on Tuesday itself. The appeal went to Chief Justice who gave permission for setting up of special bench for hearing in the case on Tuesday itself.
