Indore: While the protests are going on over the layout of under-construction bridge at Bangali Square in the city, Indore bench of Madhya Pradesh High Court disposed of a petition related to a layout dispute of a flyover at Dewas by directing the principal secretary (public works department) to pass a speaking order on complaints made by 11 aggrieved persons who moved court.
Chief Justice Mohammad Rafiq and Justice Sujoy Paul gave the verdict on June 7 giving 10 days for the petitioners to make a detailed representation to the principal secretary.
Eleven petitioners had approached the court challenging the change made in the layout of the flyover on September 10, 2020. They had claimed that the layout was changed because the previous layout was affecting a petrol pump and some land of Gayatri Raje Puar, who is the sitting MLA of Dewas.
According to the petitioners, the chief engineer, PWD floated a tender for the construction of the bridge on April 27, 2020.
A detailed estimate along with the layout dated 20/06/2019 was issued earlier.
“But with the change of the government in the state, Paur got the layout of the bridge changed as a vast area of land and a petrol pump owned by her was getting affected due by the original layout,” the petitioners’ counsel Manohar Dalal said.
He stated that the new layout has affected the sale of shops owned by the 11 petitioners which are at Krishi Upaj Mandi, Dewas.
Dalal argued in the court that undue favour was conferred upon Paur due to which grave inconvenience/hardship was caused to the petitioners.
After hearing all parties, the court directed the principal secretary to hear the petitioners/their representation as well as Puar and then pass a speaking order for redressal of the grievance of the petitioners or otherwise give justification for the change of the layout, within a period of four weeks.
