Indore: The Indore bench of Madhya Pradesh High Court on Monday issued notices to state election commissioner, district returning officer and others in connection with petition challenging the election of Sanwer MLA Tulsiram Silawat, who is also a health minister in state government.
Congress leader Silawat had won 2018 Assembly polls from Sanver constituency in Indore district by defeating sitting BJP MLA Rajesh Sonkar by 2,945 votes. Sonkar and an independent candidate Rahul Silawat filed petitions in HC under the Representation of the People Act seeking to declare Tulsiram Silawat’s victory as null and void as he allegedly violated model code of conduct and also concealed information from Election Commission.
Rahul Silawat’s counsel Pushyamitra Bhargava said Tulsiram Silawat filed the nomination form erroneously and concealed information about his social media account. Bhargava also claimed that the Congress candidate did not affix his photo on affidavit filed along with nomination papers.
In addition, the Congress candidate stated his educational qualification as “MA, LLB Part-1”, and in another place as “MA, LLB”. Justice Shailendra Shukla sought replies from state election office, district returning officer and other respondents. The next hearing of case is on March 28.
