Indore : Indore Bench of Madhya Pradesh High Court on Monday issued notice to the school education department and a Mandsaur-based private school on a petition by a teacher alleging her services were terminated by the latter without prior notice.Justice Prakash Shrivastava has also issued notice to the principal and the school administration seeking a reply from them in two weeks on a petition by Kirti Bugde.Budge claimed she joined Dastoor School in Mandsaur in 2008 as a science teacher. Her services were terminated by the school administration in April 2013 citing the reason of misbehavior.
Petitioner’s counsel Sunil Verma said, “Bugde was removed on the grounds of misbehavior but she was not given any chance to explain her point and school administration didn’t even bother to conduct any inquiry in the matter.”The petitioner has also requested court to form a tribunal for schools claiming that there are several school teachers facing such problems, but there is no forum to hear them out. Verma said that according to Section 9 of Madhya Pradesh Ashaskiya School Viniyam Adhiniyam 1975, any employee of private school cannot be terminated without giving notice and fair chance to put forth his/her side.The petitioner’s lawyer also requested the court to issue direction for quashing the termination order and re-instating the teacher.
