Indore : District Consumer Forum has penalised a city engineering college for not refunding the fees of a city resident against its own rules. The Forum has instructed the college to return the amount with simple interest to the appellant.
It has also asked the college to compensate for his physical and mental harassment and the petition expenditure.
Nilesh Patel had taken admission in RKDF College after first round of online counselling for Rajiv Gandhi Proudyogiki Vishwavidyalaya ( RGPV) and paid Rs 12,000 as fees.
However, he withdrew his admission in the second round of the counselling before the last date. Thus, as per the guidelines of the college, Patel was entitled for a refund of his fees after deduction of 10 % ( Rs 2250) ie Rs 9750. However, he was not refunded the amount in a breach of the college’s own conditions. Then he approached the Consumer Forum for justice.
There was no representation from the college. The Forum examined the documents furnished by Patel including the invoice of the fees paid by him. He also gave a copy of the letter by Counselling Committee and Directorate of Technical Education ( DTE) through which it was found that he had withdrawn the admission ( and applied for the fee refund) weeks before the stipulated deadline. Thus, it was found that the college was service deficient for not refunding the fees of the applicant as per the rules.
In an ex parte judgment, the Forum ruled in favour of Patel. The Forum instructed the RKDF College to refund the justified amount ( Rs 9750) to him within one month. It also instructed the college to pay an 8 % simple interest to him on the amount till the date of payment. It also asked them to compensate for his physical and mental harassment and the petition expenditure.
