Deprived of DSP post, girl gets justice from HC

Indore : Pallavi Shukla wanted to be a cop. She took state public service commission exam-2008 and successfully cracked it. But she could not get the job as she slipped into the list of waiting candidates following an amendment in the results by Madhya Pradesh Public Service Commission (MPPSC).

Having being robbed of her dream job, Pallavi moved Indore bench of Madhya Pradesh High Court that ruling in her favour directed the state government to appoint her as DSP. The government has to complete process within two months.

Counsel for the petitioner, Brian Da’Silva said against Pallavi had appeared for examination in November 2009 after clearing the same underwent interview in October 2010 where she opted for DSP post. Final result was declared in December 2010 in which she got selected. However, the result was amended by MPPSC in January 2011. The change pushed the petitioner into the waiting list and post for which Pallavi was selected was offered to one Alok Sharma.

Irked over this, Pallavi filed a petition challenging her exclusion from the list of selected candidates being contrary to the statutory rules and principal of natural justice.

Da’Silva said: “During the hearing, MPPSC argued that Alok Sharma was a government employee and he had scored more marks than petitioner so he was offered the post of DSP. However, it was found that there was another vacant post for DSP but that was not offered to the petitioner despite a representation given by her to home department and MPPSC.

“As per the rule if a candidate is in the waiting list and a post for which he/she is vying for falls vacant in 15 months from the time of selection then the candidate offered the post,” said Da’Silva adding that in the case of Pallavi it did not happen. He even added that she was denied the job despite vacancy in the stipulated time.

He said: “Firstly Pallavi was removed from the list of selected candidates and secondly she was not accommodated as per the rules. On both the occasions, injustice was done to her.”

After going through the case and hearing both the parities Justice S R Waghmare observed that the petitioner was selected on merit and she completed all the formalities on time. With this observation, the court directed the home department to consider Pallavi for DSP post.
