New Delhi: A 45-year-old man, caught with 8 kgs of ‘charas’ here in 2012, has been sentenced to 12 years rigorous jail term by a Delhi court, which refused to take a lenient view.
Special NDPS Judge Anuradha Shukla Bharadwaj handed down the jail term to Bihar native Baichu Ram and also imposed a fine of Rs 1 lakh on him while holding him guilty under the provisions of Narcotic Drugs and Psychotropic Substances (NDPS) Act.
“Keeping in view the facts and circumstances of the case and also considering the fact that too much leniency in sentencing will not have the deterrent effect on the convict, I am of the opinion that the ends of justice would be sub served if Baichu Ram is sentenced to undergo rigorous imprisonment for a period of 12 years,” the judge said.
While convicting Ram, the court relied on the testimonies of police raiding team and said that the recovery of charas had been duly proved.
“The case property remained untampered and the inspector has proved the receiving of sealed case property and other proceedings. The prosecution has successfully proved that eight kgs of charas kept in two bags was recovered from Ram,” it said.
The court, however, acquitted co-accused Sanjay Mahto, who had allegedly supplied the drug to Ram from Nepal, saying there was no sufficient evidence to hold that Mahto was in any kind of conspiracy with Ram.
According to the prosecution, on January 9, 2012 the Narcotics Cell had got a tip-off that Ram was to reach Anand Vihar Railway Station here early morning with huge quantity of charas, after which a raid was carried out and he was nabbed. More)
