HC quashes FIR against MP Guv citing immunity

Jabalpur : The Madhya Pradesh High Court on Tuesday quashed the FIR against Governor Ram Naresh Yadav in the MP Professional Examination Board scam, citing the immunity he enjoys while in office, but gave police the liberty to proceed “in accordance with law” once he ceases to hold the post.  “While dealing with the primary question of extent of immunity and privilege extended to the Head of a State during his term of office, which answers the jurisdictional fact, we proceed to quash the impugned FIR against the petitioner (Governor) on that count alone, with liberty to police to proceed in accordance with law, after the petitioner ceases to be the Governor,” the court said quashing the FIR.

A division bench comprising Chief Justice A M Khanvilkar and Justice Rohit Arya, however, gave police the freedom to record the statement of 86-year-old Governor “if it is so essential” but take “all salutary precautions” while doing that so the “majesty” of the office is not undermined.

“The immunity and privilege is only during the term of office. At the same time, the immunity and privilege extended to the Governor will not impair or whittle down the powers of the police to investigate the criminal case registered against other accused who cannot claim such privilege and in the process, record statement of the petitioner, if required,” the judges observed.

The judges maintained Governor Yadav’s statement in connection with the investigation can be recorded as the Constitution did not bar such an exercise.

In an interim order on April 18, the high court had stayed the FIR filed by the court-appointed Special Task Force against the Governor, asking it not to take “coercive action” against him.
