CAT asks ACC to decide on Chaturvedi’s deputation within 3 wks

New Delhi: Expressing surprise over the delay, the Central Administrative Tribunal (CAT) has asked the Appointments Committee of Cabinet (ACC), led by Prime Minister Narendra Modi, to decide in three weeks the case of deputation of IFS officer Sanjiv Chaturvedi to Delhi government.

The Tribunal observed that the officer has been compelled to approach it “again and again” for redressal of his grievances.

It said the period of deputation of Chaturvedi to the present post of deputy secretary at AIIMS would come to an end on June 28 and that the respondents — ACC, the Ministry of Environment and Forest (MoEF), and the Department of Personnel and Training (DoPT) — have not yet complied with the indicated directions.

“At the same time, the ACC was required to decide the matter of inter-cadre deputation of the applicant, as expeditiously as possible, but in vain,” the CAT said in its order, dated June 2.

“Therefore, we are of the firm view, that it would be expedient in the interest of justice, the respondents are directed to decide the matter of inter-cadre deputation of the applicant before June 28, otherwise applicant would suffer irreparable loss in this regard.

“The respondents including ACC are directed to decide the matter of inter-cadre deputation of the applicant, within a period of three weeks, from the date of receipt of a certified copy of this order positively,” the order said.

This is the third time in the past six months when the Tribunal has issued directions to ACC to decide this case.

The Tribunal on November 5 in 2015 had fixed deadline of January 5 for ACC to pass orders in this case. After Uttarakhand government withdrew its NOC which was again restored on February 24 this year, the CAT had on April 27 directed MoEF and DoPT to submit a fresh proposal regarding Chaturvedi’s proposed deputation to Delhi government within two weeks.

The request for the deputation posting of former CVO of AIIMS and Uttarakhand cadre Indian Forest Service officer Chaturvedi to Delhi government has been pending for over 15 months.
