Supreme Court watchdog for Medical Council

New Delhi: In a landmark judgment, the Constitution Bench of the Supreme Court on Monday set up a 3-member oversight committee headed by former Chief Justice of India R M Lodha to oversee all statutory functions of the Medical Council of India.

The decision came as an “epilogue” to the verdict dismissing appeals of the unaided private medical and dental colleges of Madhya Pradesh challenging the High Court’s judgment of May 15, 2009, upholding a 2007 Act passed by the State Assembly on admissions and fees in private professional institutions.

The Supreme Court also upheld the provisions of a Madhya Pradesh law which enables government to have 50 per cent shares in management seats in private dental colleges, saying there was no violation of right of autonomy of educational institutions in Common Entrance Test being conducted by the state or an agency nominated by the State or in fixing fee.

Dismissing the appeals on the ground of no error in the High Court verdict, the Court directed the Centre to notify constitution of the oversight committee within two weeks, giving it all facilities to function.
