Nagpur High Court stays to let Maharashtra’s caste validity notification

Mumbai: The Nagpur bench of the Bombay High Court on Friday stayed the notification of the state government which enable persons belonging to Scheduled Caste (SC), Scheduled Tribes (ST), Vimukta Jati and Nomadic Tribes (VJNT) and Other Backward Classes (OBC) to get caste validity by submitting their father’s validity certificate without doing process of fresh verification.

This is seen as setback to Devendra Fadnavis government who had issued notification on November 24, 2017 allowing person from blood relation to get caste validity without doing the complete process. It was the notification issued by the social justice department which have given exemption to the children and blood relatives from not follow the routine process. They have to submit caste validity certificate issued their father.

The Nagpur bench has given stay to the government notification and directed government to follow previous procedure to obtain caste validity. The bench in its judgement stated, ‘even if the validity certificate is produced, each case need to be looked as independently. The government has been asked to file its reply by October 31 to the bench.
