Mumbai: A special court designated to hear cases under Protection of Children from Sexual Offences (POCSO) on Tuesday sentenced a 21-year-old youth to ten years imprisonment for committing unnatural sex with a minor boy. However, the mother of the victim turned hostile before court. On September, 19, 2016 the 9-year-old boy complained of pain in his private parts, when his mother inquired, he said “Aap mujhe maroge toh nahi” when his mother took him in confidence he told her, “Swapnil jo dance sikhata usne mere sath ganda kaam kiya.” The boy narrated the incident to his parents and said accused had on the night of September, 17, 2016 had forcibly taken him to a place near his house and touched him inappropriately.
The mother being the complainant, in her deposition before the court turned hostile although the victim’s family had sought compensation of Rs.2 lakh under Manodhairya scheme. The Prosecution lawyer Geeta Nair brought the guilt home through the medical reports which proved the accused had commited unnatural sex with the victim. Additional Sessions Judge Nandkumar More sentenced the 21-year-old youth for committing unnatural sex under section 377 of the Indian Penal Code.
