New Delhi: The Supreme Court on Monday stayed the demolition notice of the Municipal Corporation of Greater Mumbai while barring M/s Sunbeam High Tech Developers from any further construction until further orders. Listing the matter on November 27, the Bench of Chief Justice Ranjan Gogoi and Justices Sanjay Kishan Kaul and K M Joseph ordered issue of notice to Sunbeam on the appeal of the municipal corporation. Senior advocate Shekhar Naphade appeared for the firm.
The municipal corporation has come in appeal against the Bombay High Court on March 26 holding the demolition of the premises, which also included a bar and restaurant, at Valnai village, by it as illegal without following due process of law, noting that the structures were in existence since 1964.
While permitting the firm to reconstruct the demolished structures, but only after obtaining development permission, the High Court had held that the reconstructed structures will be subject to demolition if the original structures were built without obtaining development permission.
