Justice K M Joseph who quashed President rule in Uttarakhan named for Supreme Court judge

New Delhi: Uttarakhand High Court Chief Justice K M Joseph, who had quashed the imposition of the President’s rule in the state in 2016 restoring the Congress government, has been recommended by the Supreme Court collegium for elevation to the Supreme Court as a judge.

Just a month after he had delivered the verdict in 2016 that allowed Harish Rawat to return to power, the Supreme Court collegium had recommended the Uttarakhand Chief Justice KM Jose-ph’s transfer to the joint high court for Andhra Pradesh and Telangana in Hyderabad. But the government did not clear the transfer. The high court at Hyderabad still does not have a full-time Chief Justice. Joseph, too, thus far has denied a request transfer to any High Court in south on health grounds owing to a heart problem.

The collegium also recommended the name of senior advocate Indu Malhotra practicing in the Supreme Court as judge of the Apex Court. Malhotra, who was designated as a senior advocate in 2017, will be the first woman lawyer to be directly appointed as a judge of the Apex Court, as usually such appointments are first done in the High Courts.

If cleared, she will be the seventh woman judge since Independence to make it to the Supreme Court. She will be second woman judge besides Justice R Banumathi, who is there since August 2014. Appointments are confirmed by the President only after the government accepts the recommendations of the collegium headed by the Chief Justice of India.

The first woman to be appointed as a judge of the apex court was Justice M. Fathima Beevi in 1989, followed by justices Sujata V. Manohar, Ruma Pal, Gyan Sudha Misra and Ranjana Prakash Desai.
