Mumbai : After the controversial notice of motion to regularise Yoga and Surya Namaskar in civic schools, the Shiv Sena-BJP government in the civic body now has raised concerns over the inclusion of flowerbed as usable area of approved plan earlier to fungible rule.
Owing to this, Gopal Shetty, BJP MP, wrote to Chief Minister Devendra Fadnavis citing the unwanted inclusion of flowerbed as usable area of approved plan earlier to fungible rule. He also highlighted that the some RTI activists are often complaining to the municipal authorities pointing out the inclusion of fungible area as user area.
BJP corporator Dilip Patel said, “The buildings constructed before 2012 had no rule of inclusion of flowerbed in the usable area. However, once the rule was amended, the old buildings were also charged for their flower-beds. This could have been avoided by the government since the old buildings had no such rule of flowerbeds.” Shetty further said in the letter, “After receiving the complaints from the RTI activists, the officers are issuing notices to the flat users and creating panic. In most of the cases after seeking occupation certificate developers themselves get included the flower bed area into user because they have recovered amount from flat buyers as a sale area. In such cases the most of the flat buyers get include the flower bed area into user area at their own.” Shetty also showed a statement (a copy of the statement is with FPJ) in the DCR 35 (4) for Floor Space Index which states, “Provided further that such fungible compensatory FSI for rehabilitation component shall not be used for free sale component and shall be used to give additional area over and above eligible area to the existing tenants/occupants.”
