Bombay HC to hear Bilkis Bano

Mumbai: Giving nod to hear Bilkis Bano, the victim of the infamous 2002 Bilkis Bano gang rape case, the Bombay High Court on Wednesday directed her to convert her intervention application into appeal.

The direction came from a division bench presided over by Justice Vijaya Tahilramani and Justice Mridula Bhatkar, which is hearing appeals of the 11 convicts in the case challenging the life time sentence given by a special court. The bench is also hearing the appeal of the Central Bureau of Investigations (CBI) which investigated the case. The central agency has sought death penalty for three of the total 11 convicts.

Earlier, Bilkis Bano had filed an intervention application seeking permission to be heard, but on Wednesday the bench declined to hear her as an intervener and rather suggested her to convert her application into appeal, as per the provisions under the CrPC.

Justice Mridula Bhatkar said, “We cannot hear you (Bilkis) as an intervener in the case under section 378 of the CrPC as it do not allow hearing applications for enhancing the punishment, already granted by a court.”
