SC upholds constitutional validity of IBC in entirety

Delhi: The Supreme Court upheld the constitutional validity of the Insolvency and Bankruptcy Code (IBC), thus striking down a batch of pleas on the issue contending that IBC is unconstitutional. IBC has been approved in its entirety without tweaks.

With this decision, the ambiguity and uncertainty of the process of recovery by means of IBC is eliminated. Power producers’ fate remains unknown till 4th of February on applicability of February 12, 2018 circular.
