Dindori gangrape case: Madhya Pradesh High Court confirms death sentence to two

Bhopal: Madhya Pradesh High Court, Jabalpur, on Thursday upheld the lower court judgement of death sentence to two persons in rape and murder of a 11-year-old girl in Dindori. Delivering the judgment,the court said that death penalty is measure of social necessity and also means of deterring other potential offenders.

A bench of Justice SK Seth and Justice Nandita Dubey dismissed the appeals filed by the convicts upholding the trial court verdict of death sentence to them. District court, Dindori, had awarded capital punishment to duo who had raped and murdered the minor girl on April 14,2017. HC Double bench said, “ the only punishment the accused persons deserve for having committed gruesome murder of innocent child for fulfilling lust, nothing but death”.

HC feels that it is appalled by alarming increase in recent incidents of child rapes and also being aware of rising anger of society over rapes across country, therefore, considers, death penalty is social necessity . The gruesome incident occurred when the girl’s parents had gone to Gunjhiyari village to attend some function leaving the girl back home. On their return they found their daughter missing. Next morning the girl was found dead in naked condition.

Police had arrested two persons Bhagwani, 25 and Satish, 30, for rape and murder. During interrogation, the duo confessed to have lured the girl offering ‘Kurkure’. They took the child to a nearby agriculture field and raped her. Later they strangulated her to death. District court ADJ Bhagwati Chaudhary sentenced capital punishment to the two on November 3, 2017
