Bhopal: Vyapam whistleblower asks CBI to delete paragraph from its affidavit in SC

BHOPAL: Vyapam whistle blowers Prashant Pandey have served the notice to the Central Bureau of Investigation to delete the paragraph form its affidavit submitted in the Supreme Court recently, regarding the report of Central Forensic Science Laboratory Hyderabad.

Prashant Pandey informed that the CBI have submitted an affidavit in the SC stating that the hard disk and pen drive were not tempered and those who had made allegation will be further charged by the CBI. He informed that it is in clear violation of Supreme Court’s direction dated December 15, 2016 in W.P. No. 417/2015 that the veracity of the CFSL report is subject matter of CBI Court.

In which the said report of the CFSL be submitted to the competent CBI court being dealt with in accordance with law. And importantly the trial court of CBI had not made any final verdict in the case. The CBI cannot take any action against the petitioner as the court had not directed to do so.

“Unfortunately it seems CBI as an investigating agency is more interested initiating prosecution of the whistleblower who has been agitating the VYAPAM scam for last two years before Constitutional Courts of India”. He alleged.

He had asked to withdraw paragraph 10 from the counter affidavit filed before the Supreme Court in W.P. No. 418/2015 as it is in clear contempt of the Supreme Court’s order dated December 15, 2016 in W.P. No. 417/2015 and not befitting the conduct of premier investigating agency of the country.

Such sort of threats widely reported in newspapers would demoralise a common man to approach the investigating agencies or police for reporting cognizable offences which is a duty for a citizen of this country under section 39 of Cr.PC. as the stand of CBI in counter affidavit subverts the basic tenets of criminal jurisprudence and makes it mandatory for everyone who is reporting an offence to prove the same. In case CBI fails to withdraw paragraph 10 of the counter affidavit then he may approach Supreme Court under Contempt jurisdiction against C.B.I. he added .
