BHOPAL: District and sessions court of Bhopal on Friday, has convicted a SIMI operative awarding him with life imprisonment while another one has been acquitted in murder of ATS constable of Ratlam. Farhad have been convicted with life imprisonment and Nizam has been acquitted. ATS constable Shiv Pratap Singh had succumbed to bullet injuries on June 3, 2011 in Ratlam.
The SIMI operatives had also opened fire at Sub-Inspector Manish Dubey and constable Jitendra. A case of murder under Section 302 of IPC was registered and then case was transferred to Bhopal court. ADJ Girish Dixit passed the order. Hearing was held through video conferencing and they were informed about the order through the same. Advocate Pervez Alam said, “The court has awarded life imprisonment for Farhad. The court admitted that it was not rare of rarest case. The court focused on circumstance which led to murder.” In a bid to escape, the suspected activists held an auto driver at gunpoint and fled away in his auto towards Mhow- Neemuch Road.
ATS team and local cops chased the auto- rickshaw, which stopped at a deserted location near a culvert, where an exchange of fire ensued between the SIMI activists and the cops. During 10 to 15 minutes of encounter, three members of ATS team including Suresh Bingerwal, Shiv Pratap Singh and Dipendra Panchaal sustained bullet injuries while one of the SIMI activists also injured. The activist was identified as Zakir Hussien, who was a suspect in the murder of a police constable Sitaram Yadav in Burhanpur district. The injured ATS constables were rushed to district hospital from where they were referred to CHL Hospital, one of the Jawans- Shiv Pratapsuccumbed to his injuries.
