Bhopal: NGT finds BMC lease amount ‘highly exorbitant’

Bhopal: Central Bench of National Green Tribunal (NGT) has directed the revenue department, animal husbandry department and urban development department to review the issue of the lease amount asked by BMC from the dairy owners to be shifted in the seven new designated sites on the outskirts of the city as per the NGT order earlier in May.

Directing the three departments to review the lease amount, which is said to be between Rs 20-30 lakh, the tribunal termed the rates as ‘highly exorbitant’ while passing its order on Wednesday during the hearing of the issue.

In its order, NGT said, “In terms of the direction issued on July, 3, the owners of the dairies approached BMC and were handed over allotment letters with demand note. The bench is of view that these rates are highly exorbitant. Nonetheless, we would direct that the matter be placed before the said departments for review.”

The lease amount asked by BMC has been assessed as the value for the grant of ‘patta’ (plot) based upon the value determined in accordance with the collector guidelines and development charges.

The order further said, “The three principal secretaries of said departments may resolve this issue as has been done previously in the case of Jabalpur where 19 hectares of land was set apart in terms of the directions issued by this tribunal for development of the dairy hub at Khamaria. We expect that the government would take similar view in this matter as well.”

Dictating its order, the tribunal also noted that none of the dairies were shifted to sites of Kalapani village and Tumda village which are among the seven new designated sites for the dairies developed by BMC.

During the hearing, additional commissioner, BMC, MP Singh was present on behalf of BMC and said BMC would develop the facilities in the sites within seven days to be handed over to the dairies willing to shift there.

Singh also informed the tribunal that despite being served notices and asked by BMC to to the nearby site of Kalapani village, none of the dairies of Bairagarh locality had shifted there on which NGT told BMC to shut them down from July 10 if by July 9 none shifted to the developed site.

NGT announced the next sitting on the matter to be held on July 13.
