RERA directs developer in Mumbai to register sale agreement with property buyer

Mumbai: Coming down heavily on a city developer, the Real Estate Regulatory Authority (RERA) has directed him to register a sale agreement with a property buyer which he had delayed for more than a year. After running from pillar to post for more than a year to get a sale agreement registered of her Malad flat, an elderly woman approached RERA by registering her complaint against Rupji Constructions for failing to register the agreement despite giving the necessary payments.

According to the complaint, Raisa Mohommad Gour had booked a flat jointly with her NRI daughter Sana in Rupji Signature project at Malad in 2013 for Rs 53.12 lakh. Till March 2016, Gour had made the necessary payments (Rs 40 lakh). She alleged that the developer took Rs 2.96 lakh in September 2016 on the pretext of registering the sale agreement within the next eight days. However, the developer failed to register the agreement and kept avoiding her for 10 months whenever she approached him for registration of the agreement.

Troubled with the developer’s lethargic attitude to proceed with the registrations, Gour approached RERA which got her agreement registered within a month.   A senior RERA official said, “There are many such cases where developers fail to fulfil promises made during the payments towards the buyer. The old lady had health issues and still the developer troubled her for a year. She had paid more than 10 per cent of the total cost of the flat which forces developer to register the agreement.” The official added that the developer had flouted the real estate norms. Gour also complained that the developer gave her a fake receipt of Rs 2.96 lakh which was the payment she had made for registering the sale agreement.
