Mumbai: After revoking and objecting to several provisions in the Real Estate Regulation Authority Act, members of the consumer body, Mumbai Grahak Panchayat have accused the MahaRERA of favouring the developers and has pointed out loopholes in the act. Requesting the Central Government to make amendments in the RERA act to restructure its provisions, MGP has written to Durga Mishra, Secretary at the Ministry of Housing and Poverty Alleviation citing the loopholes in the recently implemented act.

The consumer body highlighted that several developers are escaping the MahaRERA scanner by not having sanctioned building plans because of which they are not bound to register their projects. According to the act, developers should have approved building plans and commencement certificates to register these projects in MahaRERA. Homebuyers that are defrauded into such projects cannot approach MahaRERA since these projects are out of the jurisdiction of the authority.

The letter, a copy of which is with FPJ, stated, “We have come across some ongoing projects in Maharashtra wherein homebuyers have paid up to 80 per cent of the flat cost since the past four years and there is virtually no work on the site or very little progress. As the homebuyers were awaiting the registration of these projects under MahaRERA in order to seek justice, they have been now informed that these projects cannot be registered because the promoters have not obtained sanctioned plans.”
