GST on sanitary pads: SC stays proceedings in Delhi and Bombay HCs; to hear all cases

A bench headed by Chief Justice Dipak Misra agreed to hear all cases pertaining to this matter if they were stalled from being examined in state high courts.

New Delhi : The Supreme Court on Monday stayed proceedings in the Delhi and Bombay High Courts on cases related to levying Goods and Services Tax (GST) on sanitary napkins.

A bench headed by Chief Justice Dipak Misra agreed to hear all cases pertaining to this matter if they were stalled from being examined in state high courts.


Additional Solicitor General Pinky Anand had requested the Supreme Court to hear the case as many pleas were being files in different courts. Two such cases were pending in high courts.

In the Delhi High Court, a case was filed by Jawahar Lal Nehru University student, Zarmina Ishrar Khan, seeking a reduction of GST rate on sanitary napkins, while another plea was filed in Bombay High Court by Shetty Women Welfare Foundation seeking a complete exemption under the indirect tax regime.
