MP Nagar police have booked a person under Section 493 for raping a woman on the pretext of marriage while after the action courted controversy, the accused was then booked under Section 376 of the IPC. The 38-year-old complainant in the case is a woman who works in a mall after separation from her husband. She lives in the city with her son and was in a relation with accused Aditya Tanwar who promised to marry her and then “exploited” her on the pretext of it.
It was when he refused to tie knot with the victim, she filed a police complaint. However, after investigation, MP Nagar SHO, Upendra Bhati booked the accused under Section 493 while Section 376 was ignored by the SHO. It was when the woman and others pressed for cross-verification, cops booked the accused under Section 376. Superintendent of police (SP) South Rahul Kumar Lodha when contacted said the accused was earlier booked under Section which we later found was not approved by the president after which we booked him in relevant Section.
SHO Bhati when contcated said the accused was booked under section 376 while the other Section which is not valid will be discarded.
Rajendra Upadhyay, district prosecution officer when contacted said that the act has been proposed by the state government but is yet to receive the presidential nod.
